Hard Work and Just Compensation

Under Washington and California state law, truckers get a 10-minute rest break for every four hours of work. Whether you are on a per-mile, per percentage of load, per load, or a combination of both pay plan, or other piece rate plan, you’re entitled to a 10-minute rest paid rest break. Companies can’t force their truck drivers to work more than four hours without a rest break.

Truck drivers should also get paid for all time spent working required to do the job.  This often includes some non-driving time, like pre and post trip inspections, company meetings, etc. If you have not been paid separately for your rest breaks or time spent on non-driving tasks, e.g., pre- or post-trip inspections, fueling, loading/unloading, etc., you are entitled to payment. But this is not just about getting payment for the hard work you do. It’s also about your safety as a trucker.

While the “piece rate” pay plan is legal and helps businesses manage their costs, it can create an unsafe, unnecessary stressful incentives and situations for some truckers and other motorists. It can force you to get on a truck, when in actuality, your mind and body requires rest.

The Washington State Patrol reports that in the first 75 days of this year, 136 crashes involved semis.
